Opening activity — abrir atividade — is one declaration to Finanças, and it sets your tax position for years afterwards. Most of what circulates about it is close to right. The three things below are not, and each of them changes what you do.
1. There is no fifteen-day rule
You will be told to register fifteen days before you start. The Code says something simpler and stricter: the declaration is filed before you begin any activity capable of producing Category B income. No number of days appears anywhere in it.

2. Social Security is deferred, not free
The common version is that the first year is free of Social Security. What the contributory code actually says is that a first enrolment takes effect on the first day of the twelfth month after activity starts. The obligation is postponed, not waived — and two details decide whether you get the postponement at all.
- It applies to a first enrolment. Someone restarting activity pays from month one.
- It is a start date, not a discount. Once month twelve arrives the ordinary rules apply, and the quarterly declaration cycle begins with them.
What that contribution then costs is a calculation in its own right — the coefficients, the ÷3 and the €20 floor are all applied in a fixed order.
3. Your activity code does not set your tax
There are two separate registers, and you choose in both: the article 151.º table of professional activities, and the CAE classification. No crosswalk exists between them — picking a code in one does not populate the other, and neither of them determines how your income is taxed.

The simplified regime runs up to €200,000 of annual income — but one year over the line does not end it. You leave after two consecutive years above the threshold, or after a single year above €250,000.
IVA follows your own estimate
The article 53.º exemption normally looks at the previous year's turnover. In your first year there is no previous year, so the regime is decided on the figure you put on the declaration — which makes the estimate a decision rather than a formality. The threshold is €15,000, with a separate €100,000 cap for cross-border supplies within the EU.
The one genuine first-year break
There is a real relief, and it is not the Social Security one. Under the simplified regime the coefficient applied to your income is reduced by 50% in the first year and 25% in the second — but only for certain categories of income, and only if you have no employment or pension income at all. A freelancer with a salary alongside gets none of it.
How many days before starting work must I open activity in Portugal?
There is no day count. CIRS art. 112.º n.º 1 requires the declaration before beginning any activity capable of producing Category B income. The fifteen days often quoted belongs to changing an existing registration; thirty days applies to ceasing activity.
